PREAMBLE: IDENTITY OF SOCIETY

PHYTONISSE, SASU with a capital of 5,000 euros, registered in the Register of Commerce and Companies of Paris under the number 829 325 778, and whose head office is located at 8, rue Campagne Première - Bâtiment A - 75014 Paris - France, offers a line of cosmetic treatments, from the brand RemèTerre, for sale on its website www.remeterre.com.

1. OBJECT

1.1 SCOPE

The purpose of these terms and conditions of sale ('CGV') is to to inform any potential Customers of Cosmetic Products of the RemèTerre brand (here's "the (or the) Products)) about the conditions and terms in which phytoNISSE (hereinafter "PHYTONISSE") sells and delivers the product (or products) ordered from its www.remeterre.com Site (the site) and, on the other hand, define the rights and obligations of PHYTONISSE and the Customer in connection with the sale of its Products. They apply exclusively between PHYTONISSE and any individual visiting or making a purchase via that Site (hereafter "the Customer") and, without restriction or reservations, to all sales of the products offered on the Site.

The products are offered for sale in the following geographical territory: metropolitan France and the European Union. The Client will therefore have to have his main residence in one of these countries.

Deliveries can be made on request to PHYTONISSE in other territories under specific conditions.

1.2 TERMS AND CONDITIONS OF SALE REGIME

Any Order of a Product (s) proposed on the Site requires the consultation and express acceptance of these CGVs, but this acceptance is not conditional on a handwritten signature on the part of the Customer. Indeed, these CGVs are intended to organize the relationship between the Customer and PHYTONISSE until the contract is fully executed.

PHYTONISSE reserves the right to modify these CGVs at any time, in particular to adapt its commercial offer or to receive the application of any mandatory legal provisions. In this case, the applicable CGVs will be those in effect on the date of the Customer's Order.

In the event of a conflict in the application of these CGVs and any special conditions granted to the Customer, these CGVs will be applied.

If there is any doubt about the application of these CGVs, the Customer is advised to contact the Customer Service in order to receive any useful explanations. If the doubt persists, it is the client's interests that will be favoured.

2. OUR PRODUCT OFFERING AND REGULATIONS

2.1. PRODUCTS

On the Site, we offer the cosmetics of the RemèTerre range, available for sale online: they are presented with a description and accompanied by beauty tips to take care of oneself.

2.2. REGULATION

The products offered by PHYTONISSE comply with the cosmetic regulations in force according to the provisions:

  • Regulation (EC) No. 1223/2009 of the European Parliament and the Council of 30 November 2009 relating to cosmetic products,
  • 2014-201 of 24 February 2014 covering various provisions for adaptation to EU health law (Article 3).

3. OUR RATES

The rates posted on the site are shown in euros, including all French taxes (and other taxes that may apply). They do not include the delivery costs (composed of the Customer's participation in shipping, shipping and tracking equipment) that are indicated in the Customer's basket, before definitively validating his Order.

Rates can be changed at any time, without notice, especially in the event of a change in tax and/or economic data. Products will be billed on the basis of the rates in effect at the time of registration of the Order.

4. COMMAND

4.1. CUSTOMER OBLIGATIONS

The Client declares that he is at least 18 years old or emancipated and has legal capacity. The unassuming minor customer will have to ask his parents to place an order on his behalf if he wishes to access our product offer.

The contract will therefore be concluded between PHYTONISSE and the parents. It is their responsibility to ensure a perfect execution of the contract and in particular to take any precautions that would be required during the use of the Products.

The Client undertakes to communicate to PHYTONISSE the real and necessary information to carry out the subject service of these CGV as requested online and according to his situation, including his name, first name, address, phone and valid e-mail.

The Customer is responsible for the consequences arising from false or inaccurate information whose resumption would be unlawful. It can change its data under "My Account" (e-mail, billing and delivery address, password).

4.2. CREATING A CUSTOMER ACCOUNT

To order, the Customer can create an account that will allow him to access, among other things, the history of his Orders (and his invoices) or he can create a "Guest" account at the time of his Order, in which case he will not have access to this history.

When registering, the Customer chooses an identifier and password. Customers are advised to associate their ID with a valid email address.

It is the Customer's responsibility to keep their information strictly confidential and not to share it with third parties, in order to avoid as much as possible any risk of intrusion of its Customer account and the passing of orders without its knowledge by unauthorized persons. PHYTONISSE cannot be held responsible for any use of the Customer's account by a third party who has had access to his ID and password in any way.

When registering, certain required data will be requested from the Customer, including his name, first name, phone and email address.

If the Customer loses or forgets his password, the Customer will have the option to re-start his password.

4.3. ORDERING

Go to the site www.remeterre.com then:

  • Sign in to your account with your login and password, or create an account when you order.
  • To make your order by selecting the products,
  • Check the summary of his Order in the basket,
  • Make the necessary corrections,
  • To read and accept GVCs,
  • Validate his Order,
  • Control and/or change your billing and delivery details,
  • To make the payment of his Order according to the chosen method.

PHYTONISSE sends the Customer a confirmation of the Order registered on the Site (order order), then a confirmation of the processing of the Order, accompanied by the invoice (after receiving payment) by e-mail with an order number, as well as an email confirmation of the order's shipment.

As part of PHYTONISSE's environmental protection process, the Customer does not receive a paper invoice but can view and print his invoice in "My Account" at any time.

4.4. PROOF OF ORDERS

The transfer of the Order according to the chosen modality will be proof of the entirety of the said Order and will be worth the sums incurred by the Order.

PHYTONISSE will archive orders and invoices on a reliable and durable medium, constituting a faithful copy.

PHYTONISSE's computerized records will be considered by the latter and the Customer as evidence of communications, orders, payments and transactions between the parties.

At the same time, the Client may use as proof of the parties' commitments, the communications having been sent to him by PHYTONISSE on the condition that there is no alteration on his part that would distort this evidence.

4.5. ORDER VALIDATION

All orders will only be validated after acceptance by PHYTONISSE. The latter reserves the right not to validate your Order for any legitimate reason, especially in the event that:

  • It would not be in accordance with these CGVs,
  • One of your previous orders would not have been fully paid at maturity,
  • A dispute over the payment of one of your previous orders would be being processed,
  • There are several serious and consistent elements that would put a suspicion of fraud on your Order.

PHYTONISSE may accept orders within the limit of available stocks. It informs the Customer of the availability of the Product (s) sold on the Site at the time of confirmation of the Order. If, despite the vigilance of PHYTONISSE, the Product (or products) is unavailable, PHYTONISSE will notify the Customer by email as soon as possible. The Customer will then be able to cancel his Order and be reimbursed, if necessary, the sums already paid.

5. DELIVERY

5.1. DELIVERY TERMS

PHYTONISSE delivers its products via its La Poste partners in metropolitan France and throughout Europe, according to the following options:

  • Bike delivery, only in Paris.
  • Delivery via Colissimo, at home or in the post office (in France only).
  • Delivery by letter followed (envelope less than 3cm thick, only in France).

Customers can be delivered by bicycle directly to their home (valid for Paris intramuros only) at a rate of 7.50 euros TTC. For the province and Europe, Colissimo takes care of the transport and the customer will be delivered at a point of withdrawal of his choice (colis handed over against signature and presentation of an ID) or to his home for signature. Customers will have to go to the withdrawal point to pick up their parcel, available for 10 business days for a trade relay or 15 calendar days for a post office deposit. The cost of this delivery option varies depending on the weight of your package.

In case of delivery via Colissimo, the customer can follow the delivery of his parcel through a follow-up link that will be sent directly to him by email as soon as the post office is taken over by La Poste. This mode of delivery includes insurance in case of loss or looting.

Finally, for orders for "small products" that pass in a letter followed (up to 3cm thick), we will offer delivery by letter followed at a rate of 3€ TTC.

OTHER

PHYTONISSE can deliver on request to other countries. Each request received by email to contact@remeterre.com will be studied with the Customer.

The export formalities remain the exclusive responsibility of the Client who will be required to provide PHYTONISSE with immediate proof of his steps in order to enable him to meet his tax and/or accounting obligations.

5.2. FREE DELIVERY FEES

PHYTONISSE offers the delivery costs of its products as long as the order reaches a minimum amount of 60 TTC (offer valid for metropolitan France only. Delivery via colissimo in a relay point).
PHYTONISSE thus encourages the emphasis on group delivery.

5.3. INFORMATION

The customer receives his invoice by e-mail as soon as his Order is accepted.

In order to meet delivery deadlines, the Customer must ensure that he has provided accurate and complete information about the delivery address (such as: street number, building, staircase, access codes, names and/or intercom numbers, etc.).

5.4. DELIVERY TIMES

PHYTONISSE indicates an average delivery time on the product sheets (delivery tab) and on the delivery page of the Site which includes the processing time of the orders and the time it takes for the carrier to deliver. PHYTONISSE cannot be held responsible for the consequences of a delay in transport that is not the result of its own.

The risk is transferred to the Customer at the time he physically takes possession of the products (himself, a third party designated by him or a carrier designated by him).

5.5. NON-COMPLIANT DELIVERY

If, at the time of verification of the Product(s), it is very clear that the product (or these) is not (or are) not compliant with the order or that it has (or have) been damaged during transport, the Customer must refuse it (or them) and above all carry his express reservations on the delivery voucher. If the Customer returns the Product because it is (or is) not compliant with or damaged, the return costs of the Product are borne by PHYTONISSE.

6. PRODUCT EXCHANGES AND RETURNS

6.1. RIGHT AND WITHDRAWAL PERIODS

Within 14 days of receiving their order, the Customer will be able to request the return or exchange of the Product(s) from PHYTONISSE.

To do this, the Customer will need to:

  • Make a request for return or exchange by e-mail or any other statement, unambiguous, expressing the will to retract,
  • Return the Product at his own expense.


The return or exchange is done at the customer's risk. The product (or products) must be returned within fourteen (14) days in its (or their) home state, new, unan-opened, the condition of the lozenge and the un primed pump, which is authentic, accompanied by a better treatment, of the return voucher provided beforehand by PHYTONISSE, at the following address: 8, rue Campagne Première - Bâtiment A - Boîte 10 - 75014 Paris - France.

6.2. GUARANTEE OF COMPLIANCE

In accordance with the provisions of legal compliance guarantees and hidden defects, we refund or exchange products that appear to be defective or do not correspond to your order.

The provisions of this section do not prevent you from benefiting from the right of withdrawal.

7. PAYMENT

The various payment options are:

  • Payment by CB, VISA, MASTERCARD
  • Payments made via your credit card are insured by our partner Stripe.

The pricing promotions posted on the Site, or offered to you by email if you are registered in our newsletter, are valid over the specified period and terms.

8. GENERAL CLAUSES

8.1 CUSTOMER SERVICE

Any complaints should be addressed to our customer service in the shortest possible time. To allow this complaint to be followed up, the Customer is strongly advised to carry it by recommended letter with acknowledgement or even by e-mail. PHYTONISSE undertakes to process it within a reasonable time depending on the complexity of the dispute. Any claim must include the elements of fact and/or law to assess and process it. Complaints must be made to the Customer Service at 8, rue Campagne Première - Bâtiment A - Boîte 10 - 75014 Paris - France, or by e-mail: contact@remeterre.com.

8.2 MEDIATION

Any challenges that may arise regarding the validity, interpretation, acceptance and enforcement of these GVCs will be the subject of an attempt at an amicable settlement that the parties undertake to seek. Failing to do so within a reasonable time, the competent courts may be referred to the parties.

8.3 APPLICABLE LAW AND COMPETENT COURT

These CGVs are subject to French law. In the absence of any other imperative provision or in the presence of a choice in determining the applicable law, French law will be applied.

The Tribunal responsible for hearing a dispute between PHYTONISSE and the Client will be the one determined by the applicable jurisdictional rules.

8.4 PERSONAL DATA AND ARCHIVING

Information collected from Clients through the information form cannot be used for commercial use or for any canvassing. The information sent is for PHYTONISSE, which will process your requests. You have the right to access, modify, correct and delete the data collected on this Site, under the conditions provided by Law 78-17 of January 6, 1978 relating to computers, files and freedoms.

The Client's personal data is kept confidentially by PHYTONISSE for a period of 6 (six) years from the customer's last contact but may be kept longer for legal reasons.

8.5 INTELLECTUAL PROPERTY

The entire site is subject to French and international copyright and intellectual property legislation. PHYTONISSE reserves the right to sue any infringement of its intellectual rights. Any hyperlink to the Site must be expressly authorized by PHYTONISSE. The Site may include hyperlinks to other websites or internet resources outside the Site. It is up to each party to ensure that these hyperlinks are compliant with the mandatory legal provisions.
